Some charging parties seem to feel that it is desirable to file as soon as possible after the occurrence of the alleged unfair labor practice, but it is more beneficial to do some investigating before filing charges. Two facts of life apply here. First, the amount of time the agent can devote to all his cases is finite. If the agent's initial impression is that the case lacks merit, he will allocate less time to the case. If, on the other hand, the charging party knows enough about the case, the party may induce the agent to direct more effort to the case than to someone else's. Another NLRB fact of life is the 30 day time target. If the party does not uncover important evidence or witnesses until the case is 2 or 3 weeks old, it will be difficult to gather new evidence in time. A charged party, in order to elaborate on the charging party's version of a statement or to respond to other charging party evidence, must review the evidence with the charged party witnesses. Some practitioners compare NLRB proceedings to ambushes, since charges are written in boilerplate, complaints provide more than names, dates and categories of alleged violations, and there is no formal discovery. These agreements are to be arrived at by collective bargaining between representatives of the carriers and of the employees authorized to negotiate such agreements. The Act contemplates proper and authorized representation of each side. The only prohibitions in this law are against attempts of the employers to influence the, employees in their choice of representatives and against any attempt of management to change agreements governing rates, rules and working conditions, except as provided in such agreements in Section 6 of the Act, by formal 30-day written notice. Such violations by carriers are subject to prosecution by the U.S. district attorney, upon proper complaint from employee representatives, and are punishable, upon conviction, by fine or imprisonment, or both.
